When a couple decides to separate due to an irresolvable differences and issues, divorce records are automatically generated. Sadly, it is greatly increasing in number. In California, the government has developed an online server which manages the divorce cases of the state. The Freedom of Information Act has allowed the residents of a given state to access their personal records including divorce records California generates.

It is not only birth records that are accessed often by the residents of California, divorce records are also one of the requested files of the state. It is used in a number of ways. Divorce records are one of the important documents used by divorcees to claim rights to the properties they have declared during marriage. Also, one may not be able to marry again, if the separation is not legal and there is no clear documentation of the divorce. Background check is also one of the reasons why the resident of the state request for such documents. Many would like to make sure that the one's they are dating is not yet married or legally separated. This can help prevent problems should they go and marry. Genealogy research is also another use of such document. Although, it is the least document checked, if it is not updated on the family registry then problems may arise in the future.

The official certificate would contain the name of the couple who got separated as well as the date and the place where they were granted the separation. However, there is some important information that is kept away from the public to respect the privacy of the involved individual. This includes the reason for the separation and any financial related matters such as property and the custody of the children.

For records which have been registered since 1962-1984 the cost would only be $13. However, other records may have different service fees since the records can only be obtained at the county where the divorce was filed. In July 1, 2003, the government has declared that request will not be processed if the sworn statement of penalty or perjury is not signed.

The office of the Vital Records Section does not provide certified copies of the divorce paper. One can only get a certified copy at the county court where the separation was made legal. If one does not know where the couple got legal separation, one can check with the Vital Records Section and they may be able to direct you to the right county. One can send a mail request, however the sworn statement under penalty of perjury has to be signed and notarized. Without it, the request may not be processed. Instead of going to the office to file the request, one can request for the record at home.

California divorce records have been made available to the public through the Internet. This has made the retrieval of the document easier and faster since there is no need to go to any office. This is the reason why the residents of the state prefer to get it online.
